How Does Remote Notarization Work in Michigan?

In order for a document to be legally binding in Michigan, it must be signed in front of a qualified witness—i.e., a notary public. The signer and witness must also exchange identification so that the notary can confirm that the signer is who they say they are.


During a remote notarization, these requirements are met by exchanging ID via audio-video conference call and then having the signer hold up their ID to the camera so that the notary can confirm their identity. The signer must also verbally attest to their identity during the call. Once these steps have been completed, the document can be legally binding.


Are There Any Drawbacks to Remote Notarization?

While remote notarization certainly has its advantages, there are some potential drawbacks to be aware of as well. First and foremost, there is always a slight risk when completing any legal transaction online as opposed to in person since it's difficult to know for sure who you're dealing with on the other end of the connection.
